An Arizona Jury awarded 8.5 Million dollars to a family of a young girl that was hit and killed by a drunk driver. The defendants included not only the drunk driver, but the Pima County road authority. The jury found that the county road authority failed to have adequate sight distances and were negligent in the lighting of the roadway.
The Arizona daily Star reports,
The Moody family’s lawyer, John Osborne, argued the roadway conditions and visibility made it a dangerous roadway. There should have been additional lighting and signage for drivers, who could easily be confused by what Osborne said was poor visibility because of a hill, a jog in the roadway and a lack of signage at the nearby park.
The jury awarded $520,000 against the county for these road issues. The remainder of the award was against the drunk driver who was not only drunk, but operating a car with a broken speedometer and defective brakes.
